These Terms of Use ("Terms") govern your access to and use of the Lucky Earth website (luckyearth.org), Travel Risk Map (luckyearth.org/map/), and mobile application (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. About Lucky Earth

Lucky Earth is a gamified travel platform founded in Ireland. Our Services include an interactive Travel Risk Map, location-based quests, a prize wheel, community safety alerts, event organisation, and a sponsor/reward ecosystem. The Services are available via our website and Android mobile application.

2. Eligibility

• You must be at least 16 years of age to use our Services.
• If you are between 16 and 18 years of age, you confirm that you have obtained parental or guardian consent where required by your local law.
• By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

3. Account Registration

• You may register an account using your email address or Google Sign-In.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and complete information at registration and keep it up to date.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@luckyearth.org if you suspect unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Travel Risk Map

4.1 Nature of the information

The Travel Risk Map provides general travel risk indicators across categories including Transport, Weather, Crowds, Crime, Border, and Conflict. This information is:

• Aggregated from community reports, publicly available sources, and third-party data feeds
• Provided for general informational purposes only
• Subject to change without notice and may not always be accurate, complete, or current

Lucky Earth makes no representation or warranty, express or implied, regarding the accuracy, reliability, completeness, or timeliness of the Travel Risk Map data. Risk ratings reflect available data at the time of display and may not account for rapidly developing situations.

5. Prizes, Rewards, and Sponsor Offers

• Prizes won through the Prize Wheel are provided by local sponsor businesses, not by Lucky Earth.
• Lucky Earth does not guarantee the availability, quality, or fulfilment of any sponsor prize.
• Prizes are redeemed directly with the sponsor via QR code scan. Sponsors retain the right to set conditions for redemption.
• Prizes have no cash value and are non-transferable unless otherwise stated by the sponsor.
• Lucky Earth is not liable for any dispute between a user and a sponsor regarding prize fulfilment.

6. Sponsor Accounts

• Businesses wishing to become sponsors must register via the Android app and agree to the Sponsor Terms.
• Sponsors are solely responsible for the prizes they offer and for honouring them.
• Sponsors must not offer prizes that are unlawful, misleading, or harmful.
• Lucky Earth reserves the right to remove any sponsor profile or prize that breaches these Terms or is otherwise inappropriate.
• Lucky Earth may charge fees for sponsor participation — details will be communicated at the time of registration.

7. User-Generated Content

7.1 Your content

You may submit content including safety alerts, event listings, community posts, photos, and quiz responses ("User Content"). By submitting User Content, you:

• Confirm that you own or have the right to share the content
• Grant Lucky Earth a non-exclusive, worldwide, royalty-free licence to use, display, and distribute the content within the Services
• Confirm the content is accurate to the best of your knowledge (especially for safety alerts)

7.2 Prohibited content

You must not submit content that:

• Is false, misleading, or fabricated (including fake safety alerts)
• Is defamatory, abusive, discriminatory, or harassing
• Infringes any third-party intellectual property rights
• Contains personal data of others without their consent
• Promotes illegal activities or contains malware
• Violates any applicable law or regulation

We reserve the right to remove any User Content that violates these Terms without prior notice.

8. Intellectual Property

All content, features, design, trademarks, and software of the Services (excluding User Content) are the property of Lucky Earth or its licensors and are protected by applicable intellectual property laws.

• You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
• Nothing in these Terms grants you a licence to our intellectual property other than the limited right to use the Services as intended.

9. Third-Party Services and Links

Our Services integrate third-party services including map providers, analytics tools, authentication services, and booking platforms. These third parties operate independently and have their own terms and privacy policies. Lucky Earth is not responsible for the practices or content of any third-party services. Links to external websites are provided for convenience only and do not constitute endorsement.

10. Future Features (Roadmap Items)

Lucky Earth's roadmap includes features such as AI travel assistance, digital reward tokens (altcoins), a Community Ownership Programme, and Augmented Reality experiences. These features are described for informational purposes only. They:

• Are not currently available
• Are subject to change, delay, or cancellation without notice
• Do not constitute a contractual commitment by Lucky Earth

Any future token or digital asset programme will be subject to separate terms and applicable regulatory compliance at the time of launch.

You agree to indemnify and hold harmless Lucky Earth and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your breach of these Terms.

13. Termination

• You may delete your account at any time via the app settings or by contacting support@luckyearth.org.
• We may suspend or terminate your access to the Services at any time for breach of these Terms, with or without notice.
• Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — will continue to apply.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ireland. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the Irish courts, without prejudice to your rights as a consumer under mandatory EU consumer protection law.

If you are a consumer in the EU, you may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on our website or by email to registered users. Continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
